Terms of Service

These Terms of Service govern your use of Aubni. By creating an account or using any part of the service, you agree to be bound by them. If you don’t agree, don’t use Aubni.

• →You must be 18 years of age or older.
• →You must be legally capable of entering into binding agreements.
• →You must not be located in a jurisdiction where our service is prohibited.
• →Aubni is built for real estate photographers, studios, and adjacent businesses.

• →You’re responsible for keeping your login credentials secure.
• →One person per account. Each subscription is tied to a single primary user; multi-user team functionality is in development and not currently available.
• →You’re responsible for all activity that happens under your account.
• →Notify us immediately if you suspect unauthorized access.
• →We may suspend accounts that violate these terms.

What you can do

• →Upload photos for editing.
• →Create virtual tours and floor plans.
• →Deliver finished products to your real estate clients.

What you can’t do

• →Upload illegal content, copyrighted material you don’t have rights to, or content that violates third-party rights.
• →Reverse-engineer Aubni or attempt to extract our AI models or training data.
• →Resell Aubni services as a white-label competitor. (This is different from delivering edited photos to your clients — that’s allowed and expected.)
• →Use Aubni for non-real-estate purposes outside our intended use case. We may make exceptions; ask first.
• →Abuse fair-use limits or attempt to circumvent quotas.
• →Spam, harass, or harm other users or third parties through Aubni-generated content.

• →Subscriptions are billed in advance — monthly or annually based on your selection.
• →Annual billing applies a 15% discount at checkout.
• →All prices are in USD.
• →Stripe processes all payments. We never see your full card number.
• →For international customers, Stripe Tax automatically calculates and applies VAT/GST/local taxes.
• →Plan upgrades take effect immediately with prorated charges.
• →Plan downgrades take effect at the next billing cycle.
• →Founding 50 pricing is $100/mo for Edit Pro for the first 12 months from subscription activation. At the end of Year 1 the subscription graduates to standard Edit Pro pricing (currently $199/mo). Founding 50 is an Edit-only program and does not apply to Aubni Complete subscriptions.
• →Failed payments: we’ll attempt the charge for up to 7 days. If it still fails, your account is suspended until payment is resolved. Data is retained for 30 days post-suspension.

• →Cancel anytime from your account dashboard.
• →Cancellation takes effect at the end of your current billing period.
• →You retain full access until that period ends.
• →After cancellation: account deactivated, your data archived for 30 days, then permanently deleted.
• →See our Refund Policy for details on subscription refunds.

• →You retain all rights to photos you upload to Aubni.
• →You grant Aubni a limited license to process your photos solely to provide our services (editing, tour creation, floor plan generation, delivery).
• →We don’t claim ownership of your work.
• →We don’t license your photos to third parties.
• →We don’t use your photos for AI training unless you opt in — Founding 50 members and any user who explicitly enables AI training in their settings. See our Privacy Policy for details.
• →You’re responsible for ensuring you have rights to upload everything you upload.
• →If you upload content that violates third-party rights, we may remove it and suspend your account.

• →We provide the Aubni platform “as is”.
• →We continuously improve the service. Features may be added, modified, or sometimes removed.
• →We aim for 99.9%+ uptime but cannot guarantee uninterrupted service.
• →Maintenance windows are announced in advance when possible.
• →Service-affecting incidents are communicated via email and our status page (when launched).

• →Our AI tools (editing, floor plans, virtual staging, image analysis) produce results based on the photos and inputs you provide.
• →AI output is probabilistic — quality varies based on input quality.
• →You’re responsible for reviewing AI-generated content before delivering to clients.
• →We make no warranty that AI output will be perfect for every use case.
• →Founding 50 members opt in to having their edited photos and adjustment patterns used to improve our AI models — see Privacy Policy.

• →Aubni’s platform, AI models, branding, and proprietary technology are owned by Aubni.
• →These Terms grant you a license to use the platform, not ownership of it.
• →You can’t copy, reverse-engineer, or build competing services using our proprietary technology.
• →Trademark, copyright, and patent rights are reserved.

• →We can terminate accounts that violate these terms, with reasonable notice when possible.
• →We can terminate the Aubni service entirely with 60 days’ notice. (We have no plans to do this, but legally we have to disclose this right.)
• →You can terminate anytime by canceling your subscription.

• →The service is provided “as is” with no warranties of merchantability or fitness for a particular purpose.
• →Aubni’s total liability for any claim is limited to amounts you paid in the 12 months prior to the claim.
• →We’re not liable for lost profits, indirect damages, third-party actions, or force majeure events.
• →Photographers are responsible for client agreements with their own end customers.

• →California law governs these terms.
• →Disputes are resolved via binding arbitration in Los Angeles County, California.
• →Class action waiver applies.
• →(Standard SaaS dispute clause language — to be reviewed and finalized by counsel.)

• →We may update these terms from time to time.
• →Material changes communicated via email at least 30 days before they take effect.
• →Continued use after the effective date constitutes acceptance.
• →If you don’t agree to updates, you can cancel before they take effect for a full refund of any prepaid period.
